Register as an affiliate and you will have access via your on line account to a number of banners and links which you can place on your web site, emails and printed materials. The link will transport your clientele to the home page of amstardmc.com. Any purchases by your referred clientele will be commissionable to you at 10% (Subject to conditions).

View your own customer's bookings and your commission on-line, 24/7. Your on line affiliate account automatically keeps track of all purchases by your referred clientele, you can log on at any time and check to see the value of the sales attributed to your affiliate account. We have the technology in place to make sure that tracking sales is as reliable as possible. We continually strive to keep abreast of industry developments and enhance our systems to take advantage of any new technology.

Convenient Payments

Once the service has been provided and the sum of the commission due is more than US$200.00 we will send you an account statement at the months end requesting an invoice. We will pay the commission minus the cost of the bank transfer (US$38.50) within 5 working days of receiving the invoice, if the payment is US$1000.00 or more we will waive the bank transfer fee. You decide when to invoice us, if you want to defer your payments in order to avoid multiple transaction fees your balance for each month will be carried forward.

Protect yourself and your customers from illegal or unstable operators, by affiliating to a professional and established Destination Management Company.

Terms & Conditions

This Contract contains the entire terms and conditions that apply to the ?Amstar DGT Cancun, S.A de C.V? and ?Amstar DMC SA? (hereinafter, ?we,? ?us? or ?our?) and Applicant?s (?you? or ?your?) participation in the amstardmc.com?) affiliate program (the ?AAP?) with regard to the establishment of links from your web site to our web site. Accordingly, the parties agree as follows:
                                            
1) Enrollment in the AAP:
To enroll please agree to these terms and conditions and then submit the on-line AAP registration form. If, at our sole discretion, we determine that your site is unsuitable for the AAP for any reason, including, but not limited to, inclusion of content that is in any way unlawful, obscene, threatening, racially, or otherwise inappropriate, we may reject your application or terminate this contract.

2) Linking to the AAP:
You will need to identify yourself as a AAP participant on your web site.  Each product or service on your site may include a link to our amstardmc.com secured homepage, by using the link and affiliate ID that we will provide. Maintenance of your page with links to amstardmc.com is your responsibility. You may add or delete amstardmc.com products & services from your site at any time without our approval. If you wish to display the name, picture, short description, or other references of the products & services that you have listed on your site, you will be responsible for the style, contents, and placement of these references. We reserve the right to monitor your web site, as we deem necessary, to determine that you are continually in compliance with this operating contract.

3) Resources provided by amstardmc.com: 
a. We will be responsible for providing you with the information necessary to allow you to make the appropriate links from your web site to the amstardmc.com site and, in most cases, a graphic image for each title. 
b. We will be responsible for processing every order placed by a customer following the link from your site. 
c. We will track and provide an on-line sales report through your on-line account. 
4) Referral Fee (Mexico products & Services Only):
Amstar DGT Cancun, S.A de C.V shall pay a referral fee of 5% on sales on the AAP through your site.  Once a minimum commission payment of US$200.00 is due you, we will send you an account statement at month's end requesting an invoice.  Affiliate Commissions will be paid within 5 working days of receiving an invoice, less a wire transfer fee of US$38.50 (waived if transaction is over US$1000.00).  "Sales" are products & services in Mexico that have been sold, paid in full and consumed, but does not include duties, shipping and handling fees, or credit for returned goods and similar charges.
 
5) Responsibility for Your Site:
You will be solely responsible for the development, operation and maintenance of your site, and for all materials that appear on your site. This includes the equipment, the operation of your site, creating and posting product descriptions, linking those descriptions to our catalog, and the accuracy of materials and title information. You are responsible for ensuring that materials posted on your site do not violate or infringe upon the rights of any third party (i.e. any copyrights, trademarks, privacy, or other personal or proprietary rights). We disclaim all responsibility and liability for the content of your site. Further, you indemnify and hold us harmless from all claims, expenses, damages, and attorney?s fees relating to the operation and contents of your site.

6) Policies and Pricing:
Customers who buy products & services through the AAP will be deemed to be customers of amstardmc.com. Accordingly, all of our rules, policies, and procedures concerning customer orders, customer service, and sales will apply to those customers. We reserve the right to change our prices, policies and operating procedures at any time. For example, we will determine the prices to be charged for products & services under the AAP in accordance with our own pricing policies. The price and availability of products & services may vary from time to time. Because price changes shall affect products & services that you already have listed on your site, you may not want to include price information in your product & service descriptions. We will use commercially reasonable efforts to present accurate information, but we cannot guarantee the availability or price of any particular product or service.

7) Limited License to use Logos and Trademarks:
We grant you a nonexclusive, nontransferable, revocable right to access and use on your site the links utilized in the AAP in accordance with this contract through your on-line account on the amstardmc.com site. In connection with such links, you have our permission, to use our graphic images of our products & services, graphics logo images, trade names, and trademarks of Amstar DGT Cancun, S.A de C.V and Amstar DMC SA for the purpose of identifying your site as a AAP participate and generating sales of  amstardmc.com products & services. You may not alter or change the graphic or text within the graphic in any way. At any time, we reserve the right to suspend/terminate your use of our amstardmc.com logo and graphics. Your limited license will be immediately revoked at the time of the termination of this contract or by written notice as a AAP participant. 
You grant to Amstar DGT Cancun, S.A de C.V and Amstar DMC SA a non-exclusive license to utilize your names and logos from time to time to advertise, and promote the AAP. However, we are not required to advertise or promote your names or logos in any way.

8) Term of the AAP Contract:
The term of this contract begins upon our acceptance of your AAP application and will end immediately upon giving the other party written notice of termination. You are only eligible to earn referral fees on sales during the term of this contract.

9)  Notice:
Any notice required or permitted under the terms of this contract must be in writing and must be delivered to the other party by email to the registered address if to participant and to webcontactus@amstardmc.com if to amstardmc.com.

10) Modification:
We may modify terms and conditions contained in this contract at any time. Modifications may include, but are not limited to, AAP rules, changes to the referral fee structure, schedule, and payment procedures. If any modification is unacceptable to you for any reason, your only recourse is to terminate this contract. Your continued participation in the AAP following a change will constitute binding acceptance of the change.

11) Relationship of Parties:
You and Amstar DGT Cancun, S.A de C.V and Amstar DMC SA have an independent contractor relationship and nothing in this contract will create any partnership, joint venture, agency, or employment relationship between us. You will have no authority to make or accept any offers, make agreements or representations on our behalf. You will not make any statement on your site or otherwise that would contradict our relationship.

12) Disclaimers:
We make no express or implied warranties or representations with respect to the AAP or any products & services sold through the AAP (including, without limitation, warranties of fitness, merchantability, noninfringement, or any implied warranties arising out of course of performance, dealing, or trade usage). In addition, we make no representation that the operation of our site will be uninterrupted or error free, and we will not be liable for the consequences of any interruptions or errors.

13) Confidentiality:
Each of the parties agree that all information including (without limitation) this contract, Amstar DGT Cancun, S.A de C.V and Amstar DMC SA financial information, customer and vendor lists, pricing and sales information, or any AAP information shall remain strictly confidential and shall not be utilized, directly or indirectly, by you other than for the performance of this Contract.

14) Limited Liability and Indemnification:
You will indemnify, defend and hold us harmless from and against any and all actions, claims, demand, damages, expenses (including without limitation, reasonable attorneys? fees and costs) and liabilities arising from any claim or action against us resulting from your use of the products & services through this AAP.  We will give you written notice of any claim, demand, or action within ten (10) days after receiving the claim, demand or action, provided that delays in the giving of notice will not invalidate your  obligations unless you are prejudiced by the delay.  You will have the sole right to conduct the defense of any such claim, demand or action and all negotiations for its settlement or compromise unless otherwise agreed to in writing by the parties.  However, if you, after receiving notice of any such proceeding, fail to immediately begin the defense of such claim or action, we may (without further notice to you) retain counsel and undertake the defense, compromise, or settlement of such claim or action at your expense, subject to your right to assume the defense of such claim or action at any time prior to settlement, compromise or final determination thereof.  The cost and expense of counsel retained by us will be borne by you and you will be bound by, and will pay the amount of, any settlement, compromise, final determination or judgment reached while we were represented by counsel retained by us, or while you were conducting the defense.

15) Governing Law & Jurisdiction:
This contract will be governed by the laws of  Mexico with respect to Amstar DGT Cancun, S.A de C.V and the Dominican Republic with regards to Amstar DMC, without reference to rules governing choice of laws. Any action relating to this contract shall be brought in the corresponding country, and you irrevocably consent to the jurisdiction and venue of such courts. The parties submit to the exclusive jurisdiction and venue of the courts of Cancun, Quintana Roo, Mexico, with respect to Amstar DGT Cancun, S.A de C.V. and  the Dominican Republic with regards to Amstar DMC, with expressly renouncing any other jurisdiction in accordance with their domicile or in the future may have: The prevailing party in any suit or action in such court shall be entitled to be reimbursed their attorney's fees and costs actually incurred. In the event any provision of this contract shall be determined to be unenforceable by a court of competent jurisdiction, the remaining portions of this contract not so affected shall continue in full force and effect.

16) Miscellaneous:
You may not assign this contract, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this contract will be binding on, inure to the benefit of, and be enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this contract will not constitute a waiver of our right to subsequently enforce such a provision or any other provision of this contract.
 
17) AAP Participant Investigation and Execution of Contract:
You represent and warrant as follows: You have read and executed this contract with Amstar DGT Cancun, S.A de C.V and Amstar DMC SA and agree to all its terms and conditions; you understand that this contract constitutes your acceptance of this legal and binding obligation in accordance with the AAP and its terms and conditions. You understand that we may at any time (directly or indirectly) solicit customer referrals on terms that may differ from those contained in this contract or operate web sites that are similar to or compete with your web site. You have independently evaluated the desirability of participating in the AAP and are not relying on any representation, guarantee, or statement other than as set forth in this contract.
